Article 1 – Definitions

Agreement(s): Agreement between the Entrepreneur and the Consumer concerning the delivery of a Product (s) by the Entrepreneur to the Consumer at a predetermined price and conditions
Click through data: Data that is gathered and collected once a User and/or Visitor clicks on an active Link on the Website
Click through links: Links on the Website that are considered as interactive, once clicked they will lead to an action and/or other page on the Website.
Cookies: A cookie is a message given to a web browser by a web server meant to convey browsing Information of a User and/or Visitor.
Data: All qualitative and quantitative Information collected for analysis purpose.
Database: A collection of structured data, stored securely Online or Offline.
Declaration of takeover: A confirmation that will be signed by a third party in case of takeover of the Entrepreneur in order to safeguard Data in the same manner as discussed in this Privacy policy.
Entrepreneur: the “Redesignable” company that offers Product(s) to Consumers physically or remotely
Google Analytics: Software online provided by Google Inc. In order to collect and analyze Data.
Links: Links on the Website that are considered as interactive, once clicked they will lead to an action and/or other page on the Website.
Quote: All strictly formal proposals provided by Entrepreneur via Website reflecting the purchase price, shipping costs and possible additional costs for the selected Product(s) by Consumer.
Offline: All Data that is stored locally on a computer and/or other digital device that is not accessible through the Internet.
Online: All Data that is stored on an internet source and therefore is accessible through the Internet.
Online profile: The User profile that is created on the Website for (online) registered Visitors.
Order(s): All confirmations, in written form, (re)confirming the Agreement and functioning as the execution of the Agreement by the Entrepreneur.
Opt-in: A User giving explicitly permission to gather and store Data and/or to subscribe to the Newsletter receiving from Entrepreneur.
Opt-out: A User giving explicitly permission to subtract gathered and stored Data and/or substracting from the Newsletter received from Entrepreneur.
Personal information: Data collected and stored relating to a personal level; address details, contact details, product preference(s) and/or purchase history. Never included; sensitive banking – and payment information.
Privacy policy: This specific document called the Privacy policy and/or Privacy statement
Product(s): used two-hand or multi-hand furniture items, lightning and/or other decorative items offered by the Entrepreneur through the Website.
Service(s): non tangible offerings offered through the Website by the Entrepreneur.
Software: all Software, either Online and/or Offline, that has a similar function to Google Analytics.
Sustainable data carrier: any means that enables the Consumer or Entrepreneur to store information that is addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.
Third Parties: All individuals and/or organizations and/or companies that are not a direct or indirect part of the Entrepreneur.
User(s): Visitor(s) of the Website who have created an online profile and are therefore registered in the Website Database.
Visitor(s): Any person browsing and using the Website without being a (registered) User.
Website: The Website of the Entrepreneur called www.redesignable.com.
Website form(s): The contact forms that are placed on the Website; Inquiry (pop-up) form and Contact Us form
Website use; All actions that Visitor and/or User perform on the Website.

Article 4. Data collection by the Website and/or Entrepreneur;

1. Through Data tracking when browsing and using this Website;

a. Visitor(s) Data is tracked solely through Google Analytics and/or similar Software for Website optimization purposes only.
b.Click through Data via Links is tracked through Google Analytics and/or similar Software for Website optimization purposes only.
c.The Data is completely anonymous collected and abstracted in the analytics software, without storing any Personal information about the Visitor(s) and/or his Data. The Data is only meant to observe and measure analytical metrics for SEO, SEA and other Website optimization purposes.
d. The Website uses Cookies but these Cookies are only meant for a collection of abstracted Data about Website Use through the above mentioned Software. The Cookies will not be used to track browsing and buying information outside of the Website
e. The collected Data mentioned above will not be used with the goal of creating personalized promotions, sales campaigns and/or other forms of indirect or direct marketing aimed at the Visitor(s) on an individual level.

2. Through Data tracking when using the Website forms;

a. Visitor(s) Data will be collected by the use of the Website forms that allow for the Visitor(s) to inquire about a Product (s) and/or Service (s). The collected Data, among which at least the email address, possibly complemented by phone number and/or other Personal information, will be collected and used for required follow-up by the Entrepreneur.
b. This Visitor(s) Data is again collected anonymous by Google Analytics and/or similar Software with the goal of observing, measuring and analyzing Visitor(s) browsing Data, only meant for SEO, SEA and other website optimization purposes.
c. The collected Data mentioned above will not be used with the goal of creating personalized promotions, sales campaigns and/or other forms of indirect or direct marketing aimed at the Visitor(s) on an individual level.

3. Through creating an Online profile at the Website;

a. Once a Visitor(s) creates an Online profile the Website will collect and Data like Personal information, among which email address, phone number, address details and/or other (relevant) personal information. The Visitor(s) becomes a User(s) at that point. An Online profile is created in order for the User(s) to issue a formal Quote, for the Entrepreneur to issue a formal Quote, for formal and written confirmation leading to an Agreement (Order), for other/further communication between User(s) and Entrepreneur following a Quote or Agreement (Order) and/or for the User(s) to store and check Quotes and/or Agreements (Order).
b. This Visitor(s) Data is again collected anonymous by Google Analytics and/or similar Software with the goal of observing, measuring and analyzing Visitor(s) browsing Data, only meant for SEO, SEA and other website optimization purposes.
c. The collected Data mentioned above might be used with the goal of creating personalized promotions, sales campaigns and/or other forms of indirect or direct marketing aimed at the Visitor(s) on an individual level.

Article 5. Data storage by the Website and/or Entrepreneur;

1. Through Data tracking when browsing and using this Website;

a. The Data collected is stored anonymous and only on Google Analytics (Online) and/or similar other software.
b. The Data is stored only online and/or on the Database of similar software (if applicable) and never on a different location, neither online nor Offline.

2. Through Data tracking when using the Website forms;

a. The Data collected is stored anonymous and only on Google Analytics (Online) and/or similar other software. The Data is stored only online and/or on the Database of similar software (if applicable) and never on a different location, neither online nor Offline.
b. The Data that is collected through the Website form(s) is stored offline on a secured spreadsheet as well. This Data will not be used actively to approach Visitor(s) however storage of this Data is justified because when a Visitor(s) inquires back for a Product(s) and/or Service(s) the information can be easily retrieved as so to prevent mistakes and miscommunication. The Data will be stored for a period of one year in order to serve this goal.

3. Through creating an Online profile at the Website;

a. The Data collected from User(s) is stored anonymous and only on Google Analytics (Online) and/or similar other software. The Data is stored only Online and/or on the Database of similar software (if applicable) and never on a different location, neither Online nor Offline.
b. The Data that is collected from User(s) is stored both Online and Offline. Online the Data is stored in the Online profile accessible to the User(s) while the Offline Data is stored locally in a secured spreadsheet. The storage of this Data Offline is justified because a) when a User(s) inquires back for a Product(s) and/or Service(s) the information can be easily retrieved as so to prevent mistakes and miscommunication and b) The Data is Offline available for Entrepreneur in any case since information such as Quotes and Agreements (Orders) can be considered as shared documents. The Data will be stored for an indefinite period in order to serve this goal.

Article 6. The recipient(s) of the Data and Third Parties

1. The Data will be received by only 2 recipients;

a. The Entrepreneur; in the way described in articles 3.2, 3.3 and 4.2, 4.3
b. The Entrepreneur and/or Google Analytics and/or other similar Software; in the manner described in articles 3.1 and 4.1
c. The Entrepreneur ensures and safeguards that Visitor(s) Data and User(s) Data will not be transferred, either direct or indirect, to other Third parties. The gathered Data will only be used for internal purposes.
d. Only Data that is absolutely necessary to share with Third Parties because of obligations will be shared as such. An example of such would be to share Agreements (Orders) with accountants and/or tax authorities if such is necessary for the normal manner of conducting business by the Entrepreneur. In such an event, the Entrepreneur will commit to minimize the Data shared to the necessary portion which is necessary to complete such obligations. Another example of this would be to share Data with a third party shipment company in order to complete shipping.

Article 7. Permission and objection for Data storage

1. By usage of the Website Visitor(s) implicitly agree with the collection and storage of anonymous Data for Google Analytics and/or other similar Software as described in articles 3.1 and 4.1.
2. A Visitor(s)permits the storage of Data according to article 4.2, unless the Visitor(s) explicitly indicates in writing within 30 days after using the Website form that he/she wishes that his/her Data will be removed from the Offline Database. Upon receiving this objection in written form, the Entrepreneur will commit to dissolve the Data within 14 days.
3. A User(s) always accepts the General Terms and Conditions as well as the articles from this Privacy Policy once he/she creates an Online Profile. He/she explicitly gives permission for the storage of Data in his Online profile once the Online profile is created. If the User(s) wishes to dissolve his Data by dissolving his Online profile, the User(s) needs to send a written confirmation in wish he states that he wishes to dissolve his Online profile. The Entrepreneur will commit to dissolve the Profile and Data within 14 days after receiving this confirmation. However, for bookkeeping and administrative purposes the Entrepreneur will always keep copies of the issued Quotes and Agreements (Orders) (if applicable).
4. Visitor(s) and/or User(s) wishes to get insight into his stored Data, either Online or Offline, this is always possible. In such an event, a written request will suffice. Once received, the Entrepreneur will commit to respond within 14 days, thereby providing full insight into the respective Data. This Data will be rectified, adjusted and/or complemented by the Entrepreneur if the Visitor(s)/User(s) requests this and such within a reasonable timeframe.

Article 8. Newsletter subscription

1. Only a registered User(s) with an Online profile can Opt-in for the newsletter option. Once the Opt-in has been accepted the User(s) will receive a periodic newsletter up until the moment the User(s) issues an Opt-out.
2. Once the User(s) wishes to Opt-out from the newsletter, the User(s) can either click on the “unsubscribe” link in the newsletter or send a written confirmation that he wishes to Opt-out. Once received, the Entrepreneur will ensure that the User(s) will be Opt-out within 7 days.

Article 9. Security and data limitation

1. For all collection and storage of Data the utmost care will be taken in securing Data as much as possible.
2. Collection and storage of Data with regard to article 3.1. and 4.1. will be done in a secure manner through the following safety measures; a) Data will be anonymously collected and send through a secured (encrypted) connection to Google Analytics and/or similar Software, b) the website is secured through a SSL certificate and c) the website is fully protected through Google ReCAPTCHA.
3. Collection and storage of Data with regard to article 3.2. and 4.2. will be done in a secure manner through the following safety measures; a) Data will be anonymously collected and send through a secured (encrypted) connection to Google Analytics and/or similar Software, b) the website is secured through a SSL certificate, c) the website is fully protected through Google ReCAPTCHA and d) Online profile(s) are password protected according to Google ReCAPTCHA.
4. Collection and storage of Data with regard to article 3.3. and 4.3. will be done in a secure manner through the following safety measures; a) the website is secured through a SSL certificate, b) the website is fully protected through Google ReCAPTCHA, c) Online profile(s) are password protected according to Google ReCAPTCHA, d) Offline storage is only done locally, files are password protected and if Data is stored on a Sustainable Data Carrier this device will be password protected and/or encrypted as well and e) sensitive Data such as bank information, bank card information, credit card information and/or other sensitive payment information will never be stored, neither Online nor Offline.
5. There is a Data limitation for storage for any sensitive information, most likely but not limited to payment information. This will never be stored, neither Offline nor Online.

Article 10. Embedded content of other websites

1. Articles on this Website may contain embedded content (for example, videos, images, articles, etc.). Embedded content from other websites behaves in exactly the same way as if the Visitor(s) had visited the other website. The Entrepreneur has no influence and responsibility for this.
2. These external websites may collect information about you, use cookies, embed additional third-party tracking, and track your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged into that website. The Entrepreneur has no influence and responsibility for this.

Article 11. Register for processing

1. A Register will be kept by the Entrepreneur with processing activities in the Data, whereby additions, mutations and deletions will be kept. This Register will be made visible for the responsible Dutch government authority if such would be deemed necessary.
2. If there is a Data breach, this will also be included in the Register and the responsible authority will be informed immediately with the aim of limiting the damage of the Data breach as much as possible. As well, Visitor(s)s and/or User(s)s whose Data had been kept will be informed immediately as well.

Article 12. Accessibility

1. This article is also available as a separate Privacy policy for the Consumer via the Entrepreneur’s website and is publicly accessible and accessible. This document can be send by Entrepreneur per email in PDF upon request and this within 7 days upon receiving this request.

Article 13. Data takeover

1. If the Entrepreneur ever sells his company to Third parties, the Entrepreneur will have the Third parties sign a Confidentiality and integrity declaration in advance of giving access to the Data. In this declaration, the Third Parties commit in writing to take over responsibility for all that is stated in this Privacy Policy.

Article 14. Complaints

1. If a Visitor(s) and/or User(s) disagrees with this Privacy policy and considers one or more articles in this Privacy Policy as unjust, one can redirect his complaint to the governing Dutch authority (Authoriteit Persoonsgevens) addressing the issue one has with (the respective articles of) this Privacy policy.

Article 15. Data collection Opt-in and Opt-out

1. The automatic Data collection as described in Article 3.1, 4.1. and 6.1. has been automized for this Website, instead of a Visitor(s) explicitly giving permission for anonymous Data collection. This is done in order to optimize the website performance and increase the quality of the Visitor(s) experience. Further, because the automized Data collection is anonymous and only meant for abstract Website use and browsing behavior meant for internal use, the Entrepreneur assumes no wrongdoing in automating this process.
2. The Data collection according to Article 3.2, 3.3, 4.2 and 4.3 is done through an explicit Opt-in that has been made clear to Visitor and/or User in advance. This process is therefore not automatically assumed. The Opt-out is clearly described in Article 7.
3. If a Visitor(s) deems this process as unjust, one can file a formal complaint according to article 13.
